Associates in the larger and more expensive markets have been complaining ad nauseum in recent years in the Vault Associate Survey about the unfairness of pay being equal across markets when the hours expectations, billing rates, and costs of living vary greatly.

Rising 2Ls are deciding right now with which firms they will interview with during the fall recruiting cycle. As for when the pay increases will kick in, Milbank has said it will be in July and has confirmed that summer associate pay will be a pro-rata match of the first year salary. And we also like the idea of signaling to our associates that we were going to take the lead. What else could be behind the raise? Maybe the nationwide pay equality meant Milbank, with offices only in large, expensive cities, was losing out on associates who chose to work in other markets where their pay would go further.

Perhaps after years of record profits per partner at Milbank and many other top firmsthe firm decided associate morale needed a boost and felt showing them a relatively small piece of that bounty would be make their associates happier and maybe, more productive. Perhaps dwindling law school enrollment and a smaller entry-level associate pool—there were about a third fewer law school enrollees in 37, than at the peak in 51, —meant Milbank felt pressure to distinguish itself to bring in the top candidates.

While there is still no official definition of Biglaw, the industry-specific nickname loosely refers to the high-revenue law firms with large headcounts, smaller firms that pay their attorneys a market rate salary, or mid-sized firms with international reach and notoriety.

Cravath scale is a system of lockstep associate salary based on the number of years out of law school and paid to lawyers working at Cravath. All attorneys on this pay scale are paid the same and can expect to receive the same annual market bonus.

Given the lockstep nature of the system, law students and associates carefully follow any changes to the Biglaw salary scale. As Biglaw firms are always competing to get a hold on top of the class law students from top-tier law schools, the Cravath scale has virtually stayed the same across all white-shoe law firms.

While the scale is mostly based on a platform of consistency, changes have been noted throughout the years. While fresh out of law school, fortunate first-year associates have much to prove to the law firm that hires them.

Despite long hours, limited time-off, and tiresome doc-reviews, the pot of gold at the end of the rainbow is well worth it. This shows pre-recession first-years received higher bonuses, which have since waned despite an increase in base salary.

If we revisit a post-recession America, the numbers continue to show a drastic shift. There is one last tier to consider: the senior associate. So, while seemingly there are fluctuations within the Biglaw pay scale, there are tons of benefits to joining a top-tier firm. Even though high salaries are in the spotlight, Biglaw associates receive additional perks, including reimbursement for travel, as well as entertaining clients, free meals for working late, and the all-important bar expenses.

On Monday BigLaw associates and hopeful law students got some welcome news: Cravath announced it was raising its associate salaries for the first time in nearly a decade. At first it looked like it might just be the big markets. The where question is an important one. But over the years nearly every decent sized legal market has moved up to match the New York market.

So why would a new associate decide to live and work in an expensive area like New York or the Bay Area when they could make the same salary in Philly, Austin, or Charlotte?

We can only speculate as to why Cravath just raised associate pay after a decade of stagnation—though I have a little bit of insight and a few theories.

Perhaps the nationwide pay equality meant NY-based Cravath was losing out on associates who chose to work in other markets where their pay would go further.

As mentioned above, New York associates at Cravath and pretty much every other BigLaw firm have been lamenting in recent years that their pay is the same as associates in smaller markets. Perhaps after years of record profits per partner at Cravath and many other top firmsCravath decided associate morale needed a boost and felt showing them a relatively small piece of that bounty would be make their associates happier and maybe, more productive.

The fact that compensation is still at levels even though the firm is much more profitable now has not gone unnoticed, nor has the fact that salaries have been the same for a decade while the cost of living in New York has spiraled upward. Cravath just eliminated these complaints and boosted associate morale in one fell swoop. Perhaps the dwindling new associate pool meant Cravath felt pressure to distinguish itself to bring in the top associates. But not all firms are paying those amounts, and not all of them are paying special bonuses. Some law firms are paying the market-rate bonuses and offering extra cash for exceptional performance or hours.
